These terms of service and conditions apply to all services provided by 69 City Transport Ltd.

Definitions and Interpretations:

Following the Divisional Court’s ruling given on 6 December 2021, in order to operate lawfully under the Private Hire Vehicle (London) Act 1998 (the 1998 Act), a licensed operator who accepts a booking from a passenger is required to enter as principal into a contractual obligation with the passenger to provide the journey which is the subject of the booking. The operator therefore must be legally responsible for the provision of the journey (or transportation services), meaning:   

  • The operator shall accept bookings from passengers, rather than anyone else doing so.

  • The operator shall take responsibility for the journey from point A to point B, rather than anyone else doing so.

  • The booking must be carried out in a London Licensed PHV (or taxi) driven by a London licensed driver.

  • The booking must be carried out for a fare which was either agreed or for which an accurate estimate was provided in advance.

1.1 In these Conditions:

  • "These Conditions" means the standard terms and conditions of service set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between the Passenger and 69 City Transport Ltd, the Operator.   

  • "The Passenger" means the person who accepts a quotation or offer from the 69 City Transport Ltd for the provision of Services or whose booking is accepted by the 69 City Transport Ltd.

  • "The Operator" means 69 City Transport Ltd (also known as 69 City Transport), who, as a licensed operator under the Private Hire Vehicles (London) Act 1998, accepts bookings from Passengers and assumes the contractual obligation as the principal party to provide the journey that is the subject of the booking.

  • “We” and or “Us” refers to 69 City Transport Ltd.

  • "The Contract" means the contract for the provision of transport services under these Conditions.

  • "The Service" means the service of transport of the Passenger between the agreed Pickup Point and Destination Points (including any instalment of the service or any multiple services) which the 69 City Transport Ltd is to supply in accordance with these Conditions.   

  • "TfL" means Transport for London, the regulatory body for transport in London.

  • "Regulation 9(14)" refers to Regulation 9(14) of the regulations governing private hire vehicle operations as may be updated or superseded from time to time.

1.2 Any reference in these Conditions to a statute or a provision of a statute shall be construed as a reference to that statute or provision as amended, re-enacted, or extended at the relevant time.

1.3 The headings in these Conditions are for convenience only and shall not affect their interpretation.

2. Conditions:

2.1 69 City Transport Ltd shall sell and the Passenger shall purchase the Service in accordance with any quotation, agreed fare, or offer of 69 City Transport Ltd which is accepted by the Passenger, or any booking of the Passenger which is accepted by the 69 City Transport Ltd, subject in either case to these Conditions, which shall govern the Contract to the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted, or any such booking is made or purported to be made, by the Passenger.   

2.2 A contractual agreement will only come into being upon the acceptance by 69 City Transport Ltd of the booking, and the following conditions shall be deemed to be incorporated into the contract. The passenger accepts these terms and conditions by placing a booking with 69 City Transport Ltd via, but not limited to, online booking, phone call, email booking, and WhatsApp number.

2.3 The Contract will be subject to these conditions. 69 City Transport Ltd reserves the right to revise these terms and conditions at any time without prior notice at its sole discretion. A hard copy of any revised terms and conditions will be made available, and if applicable, will be posted on our website (www.69citytransport.co.uk) and will come into effect 1 hour after posting.

2.4 No booking submitted by the passenger shall be deemed to be accepted by the 69 City Transport Ltd unless and until confirmed in writing by email, text message, telephone, or otherwise by an authorised representative of 69 City Transport Ltd.

2.5 The specification for the services shall be those set out in our sales documentation unless varied expressly in the Passenger’s booking (if accepted by 69 City Transport Ltd).

2.6 69 City Transport Ltd reserves the right to make any changes in the specification of the services which are required to conform with any applicable safety or other statutory or regulatory requirements or, where the services are to be supplied to the Operator’s specification, which do not materially affect their performance.   

2.7 In entering into the Contract, the Passenger acknowledges that it does not rely on, and waives any claim for breach of, any such representations which are not so confirmed.

2.8 No variation to these Conditions shall be binding unless agreed in writing by email, telephone, or otherwise between the authorised representatives of the Passenger and 69 City Transport Ltd.

2.9 Sales literature, fare lists, and other documents issued by 69 City Transport Ltd in relation to the service are subject to alteration without notice and do not constitute offers to sell the service which are capable of acceptance. A booking placed by the passenger may not be withdrawn, cancelled, or altered prior to acceptance by 69 City Transport Ltd. No contract for the offer of service shall be binding on 69 City Transport Ltd unless we have issued a quotation or agreed on a fare which is expressed to be an offer of service, or has accepted a booking placed by the Passenger, whichever is the earlier of:

  • 2.9.1 69 City Transport Ltd’s written acceptance.

  • 2.9.2 Delivery of the service.

2.10 Any typographical, clerical, or other accidental errors or omissions in any sales literature, quotation, fare list, acceptance of offer, invoice, or other document or information issued by 69 City Transport Ltd shall be subject to correction without any liability on the part of 69 City Transport Ltd.

2.11 The fare of the Service shall be the fare agreed with the Passenger at the date of acceptance of the Passenger’s booking or such other fare as may be agreed in writing by the provider and the Passenger.

2.12 69 City Transport Ltd reserves the right, by giving notice to the Passenger at any time before delivery, to increase the fare of the service to reflect any increase in the cost to the 69 City Transport Ltd which is due to any factor beyond the control of the provider (such as, without limitation, alteration or change of booking or specifications for the service which is requested by the Passenger, or any delay caused by any instructions of the Passenger or failure of the Passenger to give 69 City Transport Ltd adequate information or instructions).

2.13 A maximum waiting time of 10 minutes for address pickups and 60 minutes for airport pickups will be allocated after the agreed pickup time has expired. Upon non-contact with the Passenger after this period, the booking will be classified as a no-show and will be subject to clause 4.4.

2.14 All payments made in any form other than cash (pounds sterling) to 69 City Transport Ltd for the provision of service and on any confirmed booking made with 69 City Transport Ltd directly will not incur any charge (booking fee).

3. Terms Of Carriage:

3.1 69 City Transport Ltd’s fares are based on Passengers being ready to travel at the booked time. Passengers must book their airport transfer in accordance with check-in times and guidelines provided by their relevant airlines.

3.2 All meets apart from “airport pick-ups” are free for the first 10 minutes; thereafter, you will be charged £0.35p per minute for the entire waiting time. Airport pick-ups: 60 minutes of free waiting time from the time the flight lands, thereafter you will be charged £0.33p per minute. (There is no charge for flight delays as the driver is dispatched accordingly).

3.3 Fares quoted or agreed are flat rates. Any diversions, additional set downs, or pickups by passengers will incur a minimum charge of £5.00 per diversion. Fares quoted that are not booked will have a validity of 24 hours. 69 City Transport Ltd reserves the right to alter any fare without prior notification; however, any quote/booking confirmed by 69 City Transport Ltd will remain binding.

3.4 69 City Transport Ltd will not accept responsibility for loss or damage to luggage. Passengers are responsible for ensuring that their luggage is loaded/unloaded at all times if accompanying the luggage on the journey. 69 City Transport Ltd has the right to refuse any passenger or to undertake the journey if the passenger has excess luggage which would result in the vehicle being unsafe whilst in motion.

3.5 Vehicles are booked by Passengers as requested. Saloon and Estate cars carry a maximum of 4 passengers and 2 pieces of luggage plus 2 hand luggage. Vehicles to carry a larger number of passengers (up to 7 passengers) and luggage are available and must be booked as required.

3.6 69 City Transport Ltd will not carry the following items in its vehicles:

  • Explosives, firearms, flammables, tear gas

  • Illegal or dangerous animals, poisonous insects

  • Hazardous waste

  • Pressurised containers (excluding personal use items in reasonable quantities)

  • Human remains

  • Opened alcoholic drinks (unless specifically agreed upon and permitted by law)

  • Illegal narcotics/drugs

  • 69 City Transport Ltd reserves the right to disallow additional goods at any time if they are deemed to be unsafe or inappropriate for carriage.

3.7 69 City Transport Ltd is committed to complying with the Equality Act 2010 and ensuring that all passengers, including those with disabilities and their assistance dogs, are carried, treated fairly, and with respect. Assistance dogs are permitted to accompany passengers at all times in all our vehicles.

3.8 Non-assistance pets are also permitted in our vehicles, provided they are appropriately secured in a carrier or harness and are not banned or illegal. 3.9 In the instance where unaccompanied luggage is transported, you agree to defend, indemnify, and hold 69 City Transport Ltd, its owner, and driver harmless from all claims, demands, causes of action, damages, liabilities, costs, and expenses, including attorneys’ fees, arising from or related to your acts or omissions in connection with your use of the Service and omissions in relation to clause 3.6 in its entirety.

3.10 In the instance where unaccompanied luggage is transported, 69 City Transport Ltd will try its level best to deliver the luggage to the exact destination as booked by the passenger. If the driver is unable to obtain a signature for the receipt of luggage on such delivery, the driver is within their remit to return the luggage to our head office where storage and additional delivery costs may be incurred.

4. Cancellation Policy:

4.1 We offer free cancellation on all bookings. However, we encourage customers to cancel their booking as soon as possible if their plans change.

4.2 To cancel a booking, customers must notify 69 City Transport Ltd via phone, email, or WhatsApp at the earliest possible time before the scheduled pickup.

4.3 In the event of a pre-paid booking that is cancelled in accordance with clause 4.2, any payments made will be fully refunded within 5 business days after the cancellation is processed. Refunds will be issued using the same payment method used for the original transaction.

4.4 No-Show Fee: If a Passenger fails to show up at the agreed pickup point at the scheduled time and does not notify 69 City Transport Ltd of their cancellation prior to the scheduled pickup time, a no-show fee equivalent to the full fare of the journey may be charged.

5. 69 City Transport Ltd Responsibility and Liability:

In accordance with the Divisional Court ruling on 6 December 2021 and to operate lawfully under the Private Hire Vehicles (London) Act 1998, 69 CITY TRANSPORT LTD, as the licensed operator, acknowledges that upon accepting a booking from a Passenger, it enters into a direct contractual obligation as the principal party to provide the journey.

As the operator, we acknowledge that we will assume full responsibility for all liability related to the transportation services rendered under accepted bookings. This includes, but is not limited to:

  • 5.1. Liability for Passenger Safety: We will ensure that all journeys are conducted safely and in compliance with all relevant regulations, thereby accepting liability for any incidents that may occur during the transportation of passengers.

  • 5.2. Risk Management: We will implement risk management practices to minimise potential liabilities, including regular vehicle maintenance and safety checks, as well as ensuring that all drivers are adequately trained in accordance with TfL guidelines.

  • 5.3. Insurance Coverage: We will maintain comprehensive insurance coverage that meets or exceeds the requirements set forth by TfL, ensuring that we are protected against potential claims arising from our operations.

  • 5.4. Clear Communication: These Terms and Conditions clearly outline our liability as the operator, ensuring that passengers are informed of their rights and our responsibilities.

  • 5.5. Incident Reporting: We will have procedures in place for reporting and addressing any incidents that occur during the course of the journeys, ensuring transparency and accountability in line with TfL requirements.

By maintaining these standards and practices, we are committed to complying with Regulation 9(14) and ensuring that our operational responsibilities are met effectively, prioritising the safety and well-being of our passengers.

6. General Applications:

6.1 69 City Transport Ltd shall not be liable to the Passenger or be deemed to be in breach of the Contract by reason of any delay in delivery or in performing, or any failure to perform, any of 69 City Transport Ltd’s obligations in relation to the Service, if the delay or failure was due to any cause beyond 69 City Transport Ltd’s reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond 69 City Transport Ltd’s reasonable control directly or indirectly:

  • 6.1.1 Act of God, explosion, flood, tempest, fire, or accident.

  • 6.1.2 War or threat of war, sabotage, insurrection, civil disturbance, or requisition.

  • 6.1.3 Acts, restrictions, regulations, byelaws, prohibitions, or measures of any kind on the part of any governmental, parliamentary, or local authority.   

  • 6.1.4 Traffic accidents, traffic hold-ups, traffic congestion.

  • 6.1.5 Strikes, lockouts, or other industrial actions or trade disputes (whether involving employees of the Provider or of a third party).   

  • 6.1.6 Flight delays, flight cancellations.

  • 6.1.7 Power failure or breakdown in machinery, including computer systems.

6.2 If clause 4.4 applies, then without prejudice to any other right or remedy available to 69 City Transport Ltd, 69 City Transport Ltd shall be entitled to charge the Passenger the full fare of the journey.

6.3 The Passenger undertakes to 69 City Transport Ltd that:

  • 6.3.1 The Passenger will regard as confidential the Contract and all information obtained by the Passenger relating to the business and/or service of 69 City Transport Ltd and will not use or disclose to any third party such information without 69 City Transport Ltd’s prior written consent, provided that this undertaking shall not apply to information which is in the public domain other than by reason of the Passenger’s default.   

  • 6.3.2 The Passenger will use all reasonable endeavours to ensure compliance with this condition. This Condition shall survive the termination of the contract.

7. Miscellaneous:

7.1 No waiver by 69 City Transport Ltd of any breach of the Contract by the Passenger shall be considered as a waiver of any subsequent breach of the same or any other provision.

7.2 If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected thereby.

7.3 The Contract shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
